YOU UNDERSTAND THAT THIS CONSUMER TRANSACTION INVOLVES A NEGATIVE OPTION AND THAT YOU WILL BE LIABLE FOR PAYMENT OF FUTURE GOODS AND SERVICES UNDER THE TERMS OF THIS AGREEMENT IF YOU FAIL TO NOTIFY THE SUPPLIER NOT TO SUPPLY THE GOODS OR SERVICES DESCRIBED.
IMPORTANT: The following Terms and Conditions are between the provider of this program, PMD Unlimited, LLC ("We", "Us", “Prime Movie Discounts”) and the enrolled member of this program ("You").
Please read these Terms and Conditions carefully. Your acceptance of these Terms and Conditions constitutes your agreement to the following Terms and Conditions as well as any terms of offer, offer details, terms of use/end user license agreement and privacy policy specified on the site. Not available in the state of Iowa, or where prohibited by law.
1. Acknowledgment and Agreement: These terms and conditions apply for this program website and service ("Service"), and is provided to You in accordance with these Terms and Conditions. The Terms of Offer or Offer Details specified on the website, the Terms of Use and End User License Agreement and Privacy Policy are hereby incorporated into and made a part of these Terms and Conditions. We may change the Terms and Conditions at any time by posting the revised Terms and Conditions on this website. If We revise the Terms and Conditions, such revision shall be effective thirty (30) days after posting the new Terms and Conditions on this website. You are responsible for periodically reviewing changes to the Terms and Conditions, which You can do by clicking on the "Terms and Conditions" or similar link. You agree that Your continued use of the Service following any changes to the Terms and Conditions and after the changes take effect will constitute Your acceptance of such changes. If You do not agree to such changes to the Agreement, Your only remedy is to discontinue use of the Service and to cancel Your account. You herby represent and warrant to us that (A) You are 18 years of age or older, (B) You will provide true, accurate, current and complete information (including and accurate email address or alternate means of contacting you) in your registration for the service, and (C) that you agree to be bound by these Terms and Conditions.
2. Description of Service: New members may receive an incentive for joining the program. As a member, You are entitled to access discounts and/or other benefits on certain products and services offered by the provider of this Service, as explained in the program materials or on the program website. Some benefits may not be available in Your area. Please see Your program materials and program website for details and limitations. This program is not available for Corporate Accounts or for customers who purchase products for business or institutional use or for the purpose of resale. We reserve the right to suspend or end the program or certain aspects thereof, without prior notice, in Our sole discretion. We also reserve the right to suspend or end certain aspects of the program in certain geographic areas, without prior notice, in Our sole discretion. We reserve the right to request additional information, to reject any order or to cancel any membership. Members are encouraged to regularly return to this website and review the Terms of service for any changes.
3. OFFER DETAILS: The monthly membership fee of $14.95 will be billed automatically to the credit card provided at the time of enrollment. Your monthly membership will continue each month thereafter and the $14.95 will be charged/ debited to the credit card provided unless you contact customer service at 888-558-1055. As a new member of Prime Discount Center you are eligible to receive 50% off of your first DVD purchase (discount not to exceed $20), free standard shipping on up to 2 items. A welcome email will be sent to the email address provided by you at the time of enrollment with your login information and the offer details of your membership.
4. DISCOUNT COUPON DETAILS: As a member of Prime Discount Center you are eligible to receive $120 in discount coupons per year in Prime Movie Discounts. You are eligible to use one $10 discount coupon per month towards your DVD purchase only. We will email you the discount code each month 14 days before availability to the email address provided if you choose to remain a member of Prime Discount Center and we are able to successfully bill the credit card you provide to us for your $14.95 monthly membership fee. To be eligible to receive your $10 discount coupon per month you must be a paying member of Prime Discount Center.
5. RENEWALS: Unless You notify Prime Movie Discounts that You do not wish to renew your membership, Prime Movie Discounts will automatically renew your membership at the end of each term and bill the then-current monthly membership fee to the credit card or debit card account designated by You when You joined.
6. RIGHT TO CANCEL MEMBERSHIP: Cancel anytime after the 14th day of enrollment so that you can utilize the great benefits of your membership. You may cancel this Agreement by calling 1-888-558-1055 or writing to the Processing Center at P.O. Box 1281 Palm Harbor, FL 34682. You will remain liable for any other fees or charges to be paid pursuant to this Agreement. A cancelling member is prohibited from re-enrolling in Prime Discount Center for at least twelve (12) months from the cancellation date.
7. Refunds: Any member receiving a full refund of the first month’s membership fee by request or due to a credit card company dispute or chargeback will have a full discount reversal for the Prime Discount Center discount received on the first purchase. The charge will be applied to the credit card provided at the time of enrollment.
8. Indemnification: You agree to indemnify, defend, and hold us harmless as well as any parent company, subsidiaries, affiliates, owners, managers, officers, employees, agents and assigns, against liability related to any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of any alleged violation of this Agreement, or any alleged violation of any rights of others.
9. Disclaimer of Warranties and Liability: The service is provide on an “as is” and “as available” basis without warranties of any kind, either express or implied, including, but not limited to warranties of merchantability or fitness for a particular purpose. We assume no responsibility for the accuracy, completeness, reliability or usefulness of any information or offers contained on, distributed through, or linked, downloaded or accessed from this website. Neither these Terms and Conditions nor any documentation furnished under it is intended to express or imply and warranty that the service will be uninterrupted, timely, or error-free. We and any parent company, subsidiaries, affiliates, owners, managers, officers, employees, agents and assigns, shall not be liable, under any circumstances or legal theories whatsoever for any loss of business, profits or goodwill, loss of use or data, interruption of business, profits, or goodwill, loss of use or data, interruption of business, or for any indirect, special, incidental, or consequential or exemplary damages, that result in any way from your use of or inability to use this service. Our liability to you shall not, for any reason, exceed the amount actually paid by you to us under this agreement. Some jurisdictions do not allow the exclusion of certain warranties or liabilities, so some of the above exclusions may not apply to you.
10. Force Majeure: Neither party shall be liable to the other for any delay or failure in performance under these Terms and Conditions resulting directly or indirectly from acts of nature or causes beyond its reasonable control.
11. Entire Agreement: These Terms and Conditions constitute the entire agreement between the parties with respect to the Service and supersede all previous proposals, both oral and written, representations, writings and all other communications between the parties.
